Quick answer: In Hyderabad, an Occupancy Certificate (OC) issued by GHMC or HMDA is MANDATORY for final home loan disbursement on ready-to-move-in apartments. While institutional lenders like LIC Housing Finance regularly sanction loans and release stage-wise tranches during construction based on sanctioned building plans, the final 10% to 15% handover tranche is legally withheld until the builder submits the official OC. For standalone residential buildings (G+2 or individual houses below 100 sq meters), GHMC building rules permit certain self-certification exemptions under TS-bPASS.

What is an Occupancy Certificate (OC)?
An Occupancy Certificate (OC) is a statutory document issued by the local municipal planning authority—either the Greater Hyderabad Municipal Corporation (GHMC) or the Hyderabad Metropolitan Development Authority (HMDA). It certifies that the building has been constructed strictly in accordance with approved architectural plans, fire safety norms, setback margins, and structural safety bylaws, making it legally fit for human habitation.
Why Do Banks Insist on an OC Before Final Disbursement?
When you purchase an apartment, the lending institution holds the property as mortgage security. If a building lacks an OC:
- Risk of Municipal Demolition / Penalties: GHMC town planning authorities have the legal power to seal unauthorized deviations or issue demolition notices to floors built beyond sanctioned height limits.
- Utility Connection Hurdles: Without an OC, securing permanent commercial electricity connections from TGSPDCL and drinking water/drainage connections from HMWSSB becomes legally problematic.
- Impaired Resale Value: When you eventually decide to sell the property, future institutional buyers will face identical loan rejection hurdles due to defective title documentation.

| Property Category | OC Mandatory for Loan? | Governing Authority | Bank Disbursement Condition |
|---|---|---|---|
| Gated Community High-Rise Towers | Strictly Mandatory | GHMC / HMDA | Final 10%–15% tranche released only after OC submission. |
| Commercial / Mixed-Use Complexes | Strictly Mandatory | GHMC / Fire Dept | No disbursement without final fire NOC & OC. |
| Standalone G+5 Residential Buildings | Mandatory for Ready Flats | GHMC / Town Planning | Sanction requires building permission (TS-bPASS, now BuildNow) + Mortgaged 10% release. |
| Independent Houses (< 500 sq meters) | Conditional / Self-Certified | TS-bPASS | Completion certificate by licensed engineer accepted. |
Can You Claim Income Tax Benefits Without an OC?
Under Section 24(b) of the Income Tax Act, tax deductions on home loan interest can only be claimed starting from the financial year in which possession is delivered. Tax assessing officers treat the Occupancy Certificate or registered possession letter as the primary legal evidence that construction is complete. If possession is delayed and no OC exists, you cannot claim regular annual interest deductions.
What Should Buyers Do If the Builder Delays the OC?
- Withhold Final Payment: Never pay the final 5%–10% builder balance until the Occupancy Certificate is handed over.
- Notify Your Lender: Inform LIC Housing Finance so the final loan tranche remains securely held in the bank’s account.
- File a Complaint with TG-RERA: Under RERA regulations, builders are legally obligated to deliver completed projects with valid OC within the declared completion schedule.
Flat in the builder’s mortgaged portion? Flats mortgaged to GHMC or HMDA can be registered only after the OC. See HMDA and GHMC mortgage flats.
Frequently asked questions
Can a bank sanction a home loan without an OC?
Yes. For under-construction projects, sanction and stage-wise disbursements are released based on approved TS-bPASS building plans. However, the final possession tranche requires the Occupancy Certificate.
What is the difference between CC and OC?
A Completion Certificate (CC) certifies that construction has ended according to specifications. An Occupancy Certificate (OC) is the final clearance confirming civic standards, water, power, and safety are compliant, permitting residents to move in.
